Operator Responsibility
KCS (Surrey) Ltd is a licensed Private Hire Operator and is responsible for both accepting bookings and providing the journey (transportation services), whether these services are carried out by its own drivers or by approved subcontractors.
Bookings
Bookings may be made via telephone, email, or online. A booking is only considered confirmed once it has been accepted by KCS (Surrey) Ltd and a booking reference number has been issued. All bookings are accepted on the understanding that the hirer agrees to these Terms and Conditions.
Cancellations
Only KCS (Surrey) Ltd, as the Operator, may cancel a confirmed booking. For vehicles carrying up to seven passengers, cancellations made less than 24 hours prior to the scheduled journey will incur the full charge. In the event of a no-show, the full contract price will also be charged. For vehicles carrying eight or more passengers, or for bookings involving multiple vehicles, cancellation terms will be as specified in the quotation. KCS (Surrey) Ltd reserves the right to cancel any booking due to circumstances beyond its control, including but not limited to extreme weather conditions, road closures, or security risks, in which case a full refund will be issued.
Payments
Deposits may be required at the time of booking. Full payment must be made within the agreed terms. Account customers will be invoiced and are required to settle invoices within 14 or 30 days as agreed. Failure to make payment may result in the suspension or withdrawal of services.
Assistance Dogs and Animals
Assistance dogs must be carried with their owners and travel free of charge, in accordance with UK law and applicable licensing requirements. Assistance dogs may support individuals with visible or non-visible disabilities and may not always display identification. Other animals are not permitted unless prior written agreement has been obtained from KCS (Surrey) Ltd.
Airport and Cruise Pickups
Airport and cruise terminal pickups include 45 minutes of complimentary waiting time. Any additional waiting time will be charged in accordance with the agreed rate. If the passenger is unable to locate the driver, they must contact the office before leaving the pickup location, otherwise the booking may be treated as a no-show and charged accordingly.
Chauffeurs
All chauffeurs are DBS checked and operate in accordance with applicable driving laws and regulations. Passengers must not request that chauffeurs exceed legal driving limits or engage in unsafe practices.
Children
Passengers are responsible for ensuring that children are secured using appropriate child restraints in accordance with legal requirements. KCS (Surrey) Ltd does not provide or install child seats.
Passenger Conduct
Passengers are expected to behave in a safe and respectful manner at all times. KCS (Surrey) Ltd reserves the right to refuse or terminate service without refund if a passenger is deemed to be under the influence of alcohol or drugs, or poses a risk to the safety of the driver, vehicle, or others.
Food, Drink and Damage
Food and drink may not be consumed in the vehicle without prior permission. Any damage to the vehicle, including soiling or vomiting, will result in cleaning and repair charges, including any associated loss of income.
Delays and Liability
KCS (Surrey) Ltd will make every reasonable effort to ensure timely arrival; however, it shall not be held liable for delays caused by circumstances beyond its control, including traffic congestion, accidents, roadworks, weather conditions, or mechanical failure. Alternative vehicles will be provided where reasonably possible.
Insurance
All vehicles and drivers are fully insured in accordance with UK law. Passenger property is carried entirely at the owner’s risk, and KCS (Surrey) Ltd accepts no liability for loss or damage.
Subcontracting
KCS (Surrey) Ltd reserves the right to subcontract bookings to other licensed operators where necessary. In all cases, KCS (Surrey) Ltd remains responsible for the booking and the delivery of the service.
Pricing and Surcharges
Additional charges may apply for services provided on public holidays, during night hours between 00:01 and 06:00, and for any parking, tolls, congestion charges, or similar costs incurred during the journey.
Waiting Time
For standard bookings, waiting time charges will apply after 15 minutes from the agreed pickup time. Airport pickups include 45 minutes of complimentary waiting time.
Complaints
Any complaints must be submitted in writing within 14 days of the service. Where appropriate, refunds will be considered on a case-by-case basis and will not exceed the cost of the journey.
Data Protection
KCS (Surrey) Ltd complies with the Data Protection Act 1998 and the General Data Protection Regulation (GDPR) and ensures that all personal data is handled securely and lawfully.
Licensing
KCS (Surrey) Ltd operates under a Private Hire Operator Licence and complies with all applicable licensing requirements.
Lost Property
Any property left in a vehicle will be logged and stored securely. Where possible, items will be returned to the owner, although reasonable charges may apply. Unclaimed items will be disposed of or handed to the appropriate authorities after 30 days.
Law
These Terms and Conditions are governed by the laws of England and Wales and form part of the contract between KCS (Surrey) Ltd and the hirer.
